Question

Do I need to disclose that an image is AI-generated?

Sometimes. The EU AI Act requires deep fake disclosure from August 2, 2026, and Meta requires it in some political and social issue ads. Elsewhere, it depends on the platform and local law.

In the EU, Article 50 of the AI Act says deployers of AI that generates or manipulates image content constituting a deep fake "shall disclose that the content has been artificially generated or manipulated." For evidently artistic, creative, satirical or fictional work, the duty is limited to disclosing it in a way that does not spoil the work. Providers of generative AI must also mark outputs in a machine-readable way.

Platforms set their own rules. Meta requires advertisers to disclose photorealistic images created or edited with generative AI in certain ads about social issues, elections or politics, and it labels images when it detects industry-standard AI indicators.

Marketplaces too: Adobe Stock requires a generative AI label on all AI content.

This is general information, not legal advice, and the rules differ by country.
